TERMS OF SERVICE
(Note: this TOS does not reflect on the Febuary 2025 - March 2026 batch and March 2026 - April 2026 batch)
This agreement is between myself, REION the "Artist" and you are the "Client".Failure to follow these Terms of Service may result in being banned from future commissions.Please read these Terms of Service carefully. By proceeding, the Client agrees they have understood all policies. For any questions or clarifications, feel free to reach out to the artist beforehand!
GENERAL TERMS
◆ I have the right to decline your commission request.
◆ Do not use my artwork for AI, NFTs, or cryptocurrency.
◆ Do not claim the artwork as your own.
◆ Do not edit or modify the artwork without consent.
◆ Reposting is allowed as long as the Artist is properly credited.
◆ Copying or replicating another artist's style will not be accepted as a commission request.
◆ All commissioned artworks may be used by the Artist for personal and portfolio purposes. This does not apply to private commissions, where the agreed privacy terms take full effect.
COMMISSION PROCESS
◆ Turnaround time varies depending on the commission type and complexity.
◆ The Artist primarily works on weekdays.
◆ Queue and waiting list are available here.
◆ The Artist reserves the right to decline any commission request without obligation to provide a reason.
◆ All commissions are delivered exclusively in digital format. (Google drive/VGEN)
◆ Commission slots are reserved and work officially begins only after full payment has been received and settled.
◆ Commission applications with no response from the Client within 10 days will be automatically cancelled.
◆ The Artist works based on the queue order or closest deadline, whichever is applicable.
◆ The following workflow and progress updates apply to all commissioned work, with the exception of SKEB commissions.
→ Initial Rough Sketch and Composition Layout
→ Cleaner Sketch with rough coloring
◆ Major revisions and changes must be requested at this stage. Client approval at this point serves as confirmation that no further major changes will be made.
→ Lining and base coloring
◆ The Client may still submit minor revision requests during this stage.
→ Rendering
◆ The artwork is in its final production stage. Revision requests submitted at this point will not be acknowledged or acted upon.
◆ REVISION GUIDELINES
Major Revisions include, but are not limited to:
→ Changes to the overall concept, composition, pose, redesigning (etc.)
→ Adding characters, props, or elements that were not part of the original commission brief.
Minor Revisions include, but are not limited to:
→ Adjustments to hair, skin, or any base color, as well as minor positioning changes to specific elements.
→ Adding characters, props, or elements that were not part of the original commission brief.
◆ The turnaround time for highly complex commissions will exceed the standard timeframe. An estimated completion time will be communicated to the Client at the time of booking.
PAYMENT POLICY
◆ Payment is due upon receipt of the Artist's invoice. All transactions are to be processed exclusively through PayPal or VGEN.
◆ All prices are listed in USD
◆ Payment installments are available exclusively for commissions totaling above $150, subject to prior agreement with the Artist. A minimum payment of $50 per installment is strictly required.
◆ PRIVATE COMMISSIONS
Subject to an additional fee of 50% of the total commission cost
→ The Artist will not document, stream, or share any part of the commission process on any platform or social media.
→ Upon completion, the final artwork will not be publicly displayed on the Artist's social media, portfolio, or any public platform.
→ The Client must specify one of the following at the time of booking:
◆ The artwork will not be showcased publicly within 30 days of completion.
◆ The artwork will not be showcased publicly at any time, indefinitely.
◆ MONETIZED CONTENT
Subject to an additional fee of 50% of the total commission cost
→ This fee is mandatory if the commissioned artwork will be used in any capacity that generates direct or indirect revenue, including but not limited to:
◆ Monetized video productions, music videos, advertisements, or marketing materials.
→ The Client is responsible for disclosing intended monetized use prior to payment. Failure to do so does not exempt the Client from this fee.
→ This fee does not apply to non-monetized stream overlays or video thumbnails.
◆ COMMERCIAL MERCHANDISING
Subject to an additional fee of 150% of the total commission cost
→ This fee is mandatory if the commissioned artwork will be used for mass production, distribution, or any form of commercial sale, including but not limited to:
◆ Printing the artwork on physical or digital products for sale.
◆ Incorporating the artwork into merchandise design intended for commercial distribution.
→ The Client is responsible for disclosing intended commercial use prior to payment. Undisclosed commercial use discovered after the fact will be treated as a violation of these Terms of Service.
◆ RUSHED COMMISSION FEE
Subject to an additional fee of 50% of the total commission cost
→ A rushed commission fee is mandatory for any deadline requested within 1 week of the commission start date.
→ The Artist reserves the right to decline rushed requests if the timeline is not feasible, regardless of fee.
◆ OTHER CHARGES
Subject to an additional fee of 50% of the total commission cost
→ Commissions involving highly complex designs are subject to additional charges at the Artist's sole discretion. The Client will be informed of any additional costs prior to invoicing.
→ An additional design fee will be applied for original design work, including but not limited to:
◆ New characters, mascots, or outfit designs created without provided references.
◆ All additional charges must be agreed upon by both parties in writing before work commences.
REFUND & CANCELLATION
◆ Refunds and cancellations are only available under the following circumstances. Please read carefully!
→ The Artist is the one who initiated the cancellation, or is unable to complete the commission for any reason.
→ Work on the commission has not started within 6 months from the date payment was received.
◆ If delays are caused by the Client, such as late responses, missing references, or lack of communication, the commission may be cancelled if no clear and reasonable explanation is provided in a timely manner.
◆ Outside of the circumstances listed above, refunds and cancellations are unfortunately not available. The Artist kindly asks that the Client carefully review all policies before proceeding with a commission.
◆ Chargebacks and payment disputes are strictly prohibited. Any such action will be considered a violation of these Terms of Service and dealt with accordingly.
USAGE RIGHTS
◆ The Artist retains full intellectual property rights and copyrights over all commissioned artworks and any original designs created. Intellectual property rights of any existing characters depicted in the commission remain with their respective original owners.
◆ All commissioned artworks are strictly for personal use only, unless the Client has explicitly purchased the applicable commercial rights as outlined in the Commercial Use policies above.
◆ The Artist reserves the right to stream the commission process on Twitch and/or showcase the final artwork across any social media platform, unless the commission has been designated and paid for as a Private Commission.
◆ The Client is strictly prohibited from reselling any commissioned artwork purchased under personal use terms. Reselling without prior written consent from the Artist will be considered a direct violation of these Terms of Service.
